IP Alert | Vietnam | New Circular Providing Increases in Industrial Property Charges and Fees

Effective 1 January 2017, official fees to be charged by National Office for Industrial Property (“NOIP“) applicable to applications for registration and protection of industrial property rights will be increased by 50 to 70 percent depending on each type of application.

On 14 November 2016, the Ministry of Finance of Vietnam (MOF) issued Circular No. 263/2016/TT-BTC which stipulates the official fees to be collected by the National Office of Intellectual Property of Vietnam (NOIP) for industrial property-related activities (“Circular 263“)

Notable changes to Circular No. 263 include the following:

  • Official fees for filing applications are no longer charged on the basis of classes. This means that the official fees for filing applications are now based on only the application notwithstanding that it is a multi-class application.
  • Official fees for filing applications in 3 forms (filing on papers, filing on papers with a copy in electronic form and filing online) are no longer different.  There is only one rate of official fee applicable for any form of filing.
  • Official fees for filing requests for expedited examinations of an application no longer exist.

In addition, many other changes are described in Circular 263.
