Companies to note DICA’s notification requirement

On 26 August 2015, the Directorate of Investment and Company Administration of Myanmar (“DICA”) published a notification on its website requesting all companies to file a notice with DICA by 14 September 2015, stating whether the company is still operational and actively engaging in business in Myanmar. According to our face to face meeting with an official from DICA, we were informed that failure to do so may result in the company being wound up.

We were also advised by the official from DICA that a company should provide written notification by sending a formal letter on its company letterhead. For the convenience of our clients we have attached the sample cover letter for your reference. Please note that the letter to DICA should also be submitted with the following documents:

  • Most recent Form 26 containing the particulars on Directors, Managers and Managing Agents and or any changes therein; and
  • Certificate of Incorporation and Permit to Trade.
