Malaysia had, on 27 September 2019, deposited its instrument of accession to the Madrid Protocol with the World Intellectual Property Organization (WIPO). This paves the way for the much awaited implementation of the Madrid Protocol in the Malaysian trade mark system.

In conjunction with the deposit of the instrument of accession, the Minister of Domestic Trade & Consumer Affairs announced in his speech that the Protocol will come into force in Malaysia on 27 December 2019. It is anticipated that Malaysia’s new Trademarks Act 2019 (“TMA”) will also come into force on the same date. The Intellectual Property Corporation of Malaysia (MyIPO) is currently conducting public consultations on the new Trademark Regulations which will accompany the new TMA.
